The terms that cover your use of our website, our content and your donations to CBB Canada, a registered Canadian charity.

1. Acceptance of these terms

Please note: this page holds sample template text drafted for a Canadian registered charity. Treat it as a working starting point. It should be reviewed and approved by qualified legal counsel before CBB Canada relies on it or publishes it live.

These Terms & Conditions (the “Terms”) govern your access to and use of the CBB Canada website, its content, forms and any related services we make available online (together, the “Site”). By accessing, browsing or otherwise using the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference.

If you do not agree with any part of these Terms, please do not use the Site. We may also post additional terms that apply to specific activities (for example, fundraising campaigns or events); where they apply, those terms form part of this agreement.

2. About CBB Canada

CBB Canada (Humanity Knows No Borders) is a registered Canadian charitable organization. We run humanitarian relief and community programs both internationally and here in Canada. That work includes clean water, food, education, medical care, support for orphans and widows, and emergency response.

References to “we”, “us” and “our” mean CBB Canada. References to “you” mean the individual or organization accessing the Site.

3. Use of the website (acceptable use)

You may use the Site for lawful, personal and non-commercial purposes connected with learning about, supporting or donating to CBB Canada. You agree not to use the Site in any way that is unlawful, harmful or that could damage, disable, overburden or impair it. In particular, you agree not to:

  • attempt to gain unauthorized access to any part of the Site, its servers, or any connected systems or networks;
  • introduce viruses, trojans, worms, or other material that is malicious or technologically harmful;
  • use any automated system, robot, scraper or data-mining tool to access, copy or harvest content or personal data from the Site;
  • impersonate CBB Canada, our staff or volunteers, or misrepresent your affiliation with us, including for fraudulent fundraising;
  • post or transmit content that is defamatory, obscene, discriminatory, or that infringes the rights of any third party; or
  • use the Site in any manner that breaches applicable Canadian federal or provincial law, or the laws of any jurisdiction from which you access it.

We reserve the right to restrict or withdraw access to the Site, or to any feature within it, at our discretion and without notice where we reasonably believe these Terms have been breached.

4. Donations & payments

Online donations to CBB Canada are processed securely by our third-party payment provider, Fundraise Up, and its underlying payment processors. When you make a gift you also agree to Fundraise Up’s applicable terms and to the relevant card-network and payment-processor terms. All amounts are shown and charged in Canadian dollars (CAD) unless stated otherwise.

  • One-time gifts are charged once at the time you confirm your donation.
  • Recurring (monthly) gifts continue to be charged on a regular schedule until you cancel. You can change or cancel a recurring gift at any time by contacting us at [email protected] or through the management link in your donation confirmation email.
  • Designations. Where you choose to support a specific program or appeal, we apply your gift to that purpose. If a program is fully funded or cannot proceed, we will direct your gift to the area of greatest need in keeping with our charitable objects and CRA requirements.
  • Official tax receipts. Eligible donations are tax-receipted in Canada. We issue official tax receipts in accordance with Canada Revenue Agency (CRA) rules; please ensure the name and email you provide are accurate so your receipt reaches you.
  • Errors & refunds. If you believe a donation was made in error or for an incorrect amount, contact us promptly and we will work with you to resolve it in line with our refund practices and CRA guidance.

CBB Canada does not store your full card details on the Site; payment data is handled by our PCI-compliant payment provider. Please see our Privacy Policy for how we handle the personal information associated with your donation under Canada’s PIPEDA and applicable provincial privacy laws.

5. Intellectual property

The content on the Site is owned by CBB Canada or its licensors and is protected by Canadian and international copyright, trademark and other intellectual-property laws. This covers text, graphics, logos, the CBB Canada name and marks, photographs, illustrations, icons, audio, video, page layout, and software.

You may view, download and print content from the Site for your own personal, non-commercial use, provided you keep all copyright and proprietary notices intact. You may not otherwise reproduce, republish, distribute, modify or create derivative works from any part of the Site without our prior written permission. The CBB Canada name, logo and tagline (Humanity Knows No Borders) may not be used without our consent, including in any way that suggests endorsement or affiliation that does not exist.

7. Disclaimers & "as is"

We work to keep the Site accurate, helpful and available. However, to the fullest extent permitted by law, the Site and all content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that the Site or its servers are free of viruses or other harmful components. Content, including program descriptions, statistics and impact figures, is provided for general information and may change; some figures shown on the Site are illustrative and to be confirmed. Nothing on the Site constitutes professional, legal, financial or tax advice.

8. Limitation of liability

To the fullest extent permitted by applicable law, CBB Canada and its directors, officers, employees, volunteers and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, revenue, goodwill or anticipated savings, arising out of or in connection with your access to, use of, or inability to use the Site. This applies whether the claim is based in contract, tort (including negligence) or any other legal theory, and even if we have been advised of the possibility of such damages.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or for death or personal injury caused by negligence. Where our liability cannot be excluded but can be limited, it is limited to the maximum extent permitted by law.

9. Indemnity

You agree to indemnify, defend and hold harmless CBB Canada and its directors, officers, employees, volunteers and agents from and against any claims, liabilities, damages, losses and reasonable expenses (including legal fees) arising out of or related to your breach of these Terms, your misuse of the Site, or your violation of any law or the rights of a third party.

10. Governing law & jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter are governed by and construed in accordance with the laws of Canada and the laws of the province in which CBB Canada maintains its registered office, without regard to conflict-of-laws principles. You agree to submit to the exclusive jurisdiction of the courts of that province for the resolution of any dispute, subject to any mandatory rights you may have under applicable consumer-protection law.

11. Changes to these terms

We may update or amend these Terms from time to time to reflect changes in our services, the law or best practice. When we do, we will revise the “last updated” date shown on this page. We may also highlight material changes on the Site. Your continued use of the Site after changes take effect constitutes your acceptance of the revised Terms, so it is worth checking this page now and then.
